Is Kratom Legal in Wyoming? [2023 Update]

While kratom is federally legal, that doesn’t necessarily mean it is allowed in your area. States can pass kratom laws, and some have used that power to impose regulations or bans. So, is kratom legal in Wyoming?


As of February 2023, kratom is legal and unregulated in Wyoming. The state has not passed any kratom-related legislation, and the substance is legal in all of Wyoming’s counties and municipalities. This is an ideal scenario for the state’s kratom consumers!


In this post, I want to dive deep into Wyoming’s kratom market. I will explore the history of kratom law in the Equality State and look at where the industry could go next. I will also pick out some excellent places to buy kratom in Wyoming. Ready? Let’s do it.

Yes, there are no caveats to kratom’s legal status in Wyoming. The plant is 100% legal, with no restrictions on product manufacturing, selling, buying, possessing, or using. This situation exists because the state does not classify kratom as a controlled substance.


In addition, no Wyoming counties, cities, towns, or parishes have banned kratom or the plant’s indole alkaloids. When a jurisdiction bans kratom, it does so by making the plant or its alkaloids illegal.


And you can chill if you live near the state border. Kratom is legal in Colorado, Idaho, Montana, Nebraska, South Dakota, and Utah, the six states neighboring Wyoming.

History of Kratom Law in Wyoming

There is little to report on kratom legislation in Wyoming. In contrast to many states, no lawmakers have ever sponsored bills to make kratom illegal or to call on the authorities to study it.


Introducing a bill requires little effort. It only takes one lawmaker, and they could do so for any reason. However, many bills die in committee before a vote is held - this often happens with state-level legislation to ban kratom.


However, we should remember that Wyoming is a small state with a population under 580,000, the least of anywhere in the U.S.! It is possible that lawmakers don’t know much - if anything - about kratom and that it just isn’t a substance of concern in the region.


But that doesn’t guarantee kratom won’t become a hotter topic in the future. It may only take one incident to spark a scandal, such as if a batch of contaminated kratom went on sale. The lack of knowledge among legislators might then increase the risk of a ban.


That is why kratom advocacy groups push for regulation and promote bills like the Kratom Consumer Protection Act (KCPA). But what is the KCPA, and could such legislation come to Wyoming?

Wyoming Kratom Consumer Protection Act

Most U.S. states have an unregulated kratom market. While this allows anybody to sell and buy products, it means product quality is often inconsistent. There have been instances of contaminated kratom sold in unregulated states and making people sick.


That is bad for consumers, as well as for genuine manufacturers and retailers. But passing the KCPA can put an end to such incidents by demanding that products meet certain standards, in terms of ingredients and labeling. Features of the KCPA include:


  • Making contaminated and dangerously adulterated kratom products illegal

  • Requiring products to come with a certificate of analysis from an independent laboratory

  • Requiring the product labeling to have directions for safe and effective use

  • Prohibiting kratom sales to minors

  • Imposing penalties for KCPA violations


Passing the KCPA would protect Wyomingites from bad actors and harmful products. But it would not impinge on the rights of everyday kratom users to access the high-quality products they need.


Despite the upsides, the Equality State is yet to pass - or even vote on - a KCPA bill. This is another indication of how kratom is not on the legislative radar.

Will Wyoming Keep Kratom Legal?

All signs point toward kratom remaining legal in Wyoming. There have been no ban attempts, it doesn't look like any lawmakers hold a grudge, and the topic receives little if any press coverage. I guess the Wyoming Legislature feels it has more important things to worry about!


While regulating kratom has benefits, it would also put the plant on the state’s legal agenda, which could make things unpredictable. There is an argument that doing nothing may be more effective at looking after kratom users in Wyoming.

Federal Kratom Law

Wyomingites concerned about kratom access should pay more attention to the federal government. Since the state doesn’t have a kratom policy, it could rubber-stamp changes at the federal level into Wyoming law without debate.


The Drug Enforcement Administration (DEA) lists kratom as a Drug and Chemical of Concern. This doesn’t affect its legal status, but the DEA once wanted to classify kratom as a Schedule I drug, grouping it alongside ecstasy, heroin, LSD, raw opium, and more.

Where to Buy Kratom in Wyoming

The legal landscape makes purchasing kratom in Wyoming a straightforward process.


But Wyoming is a geographically large state with a tiny population. If you live in a remote region, finding kratom at a brick-and-mortar store might be more hassle than it is worth. In this scenario, the internet is your friend. Indeed, I would argue that America’s best kratom vendors are online.


The leading online kratom shops always have the all-important third-party lab results to confirm products are genuine and pure. You rarely get such a service when buying kratom at a gas station or convenience store.


Furthermore, online stores often stock more strains and product types (i.e., kratom edibles!) than physical vendors. Prices are generally cheaper, and you can get orders shipped swiftly to your home. For me, all these perks make online shipping an easy decision.


However, if you live in Cody, Cheyenne, Sheridan, or another populated part of Wyoming, buying kratom at a brick-and-mortar shop could be feasible. Here are three stores I found.

Final Thoughts

Wyoming seems to have no opinion on kratom. Its legality has never been threatened, but there has been no push for market regulation.


Consumers will be thankful for the relaxed approach. That said, I recommend researching the brands and vendors you buy from.
